Terms & Conditions of Use
- This is a game of skill. This is not a game of chance.
This is not a gambling mechanism. In order to create a winning team
roster of drivers chosen via matchup selection, a player must
possess the skill and knowledge to correctly select the best
finishing driver or team car from a given set of drivers or team
cars, based upon race finish results. Please see
#19 of the FAQ's for a complete listing of
my reasons why fantasy racing is not gambling.
- Prizewinners will be determined based upon all eligible
entries. Eligible entries are defined as the pay to play team
managers that have provided FantasyDriverMatchup.com with funds for
each team based upon our pricing model. Free team requests received
as described in number nine (9) below are eligible to compete in the
shootouts, however free team managers will not be eligible for
prizes. Pay to play team managers and owners will be considered
eligible for the prizes outlined in the “Prize Schedule” located on
the homepage, once receipt of payment for the purchase of
a team or teams has been received as described in number seven (7)
below.
- A player is not limited to one team. A player may
purchase up to 10 teams to compete in any shootout. All teams
managed by a team owner will be considered for scoring purposes. In
other words, we will not use only your best scoring team for ranking
purposes; all of your teams will be ranked in order of the most
points earned. For those managers competing in the 1-race or 9-race shootouts,
your teams if you have multiple teams competing, will all be scored
independently of each other similar to the 1-race shootouts.
- The game results will be calculated as stated in the toolbar
tab titled “Official Rules” located at the
top of the homepage.
- Player divisions are limited to 12 teams. This limit has
been set at 12 players to allow a reasonable opportunity for all to
compete and win. At no time will a player compete against more than
11 teams. *Does not apply to the Unlimited League.
- If less than 12 teams are playing the game within a
division, FantasyDriverMatchup.com reserves the right to activate
and utilize the prorated prize schedule based upon the amount of
teams playing the game within a particular division. This
alternate prize schedule is found on the homepage. *Does not apply to the Unlimited League.
In order to play the game a team owner or team manager must
be 18 years of age or older, have access to the Internet to obtain
copies of the upcoming race matchups (posted late Wednesday nights)
and have access to the Internet for team
management and roster formation via matchup selection. A team
owner or manager must provide payment for ownership of a team via
credit card, debit card, electronic check, personal check or money
order. Payment for purchase and ownership of a team must be received
prior to the start of the particular shootout a potential player
wishes to compete within. If the payment is not received prior to
the start of the shootout, refunds or credits for play in the next
available shootout will be offered. Payment for the purchase of a
team or teams may be mailed to: 7710-T Cherry Park Drive, #103

you mail a payment, it must be received no later than 24 hours prior
to the start of a shootout in order to allow enough time to manually
create your team information. Please include the following items
with your payment; your name, address, phone number, email address,
team name, password, driver's license number and state issued and
instructions as to which shootout(s) you wish to compete in.
At no time will team roster or matchup selections be
processed via the telephone. It is simply too difficult and
costly to schedule personnel to be available for telephone access.
Team roster formation via matchup selections may be mailed to
FantasyDriverMatchup.com via US Mail. The mailed in team roster must
be received by FantasyDriverMatchup.com no later than 24 hours prior
to the scheduled start of the upcoming shootout that the player
wishes to compete in. Mailings for team roster formation via matchup
selections may be sent to:

we strongly discourage the use of the US Mail. We are unable to
guarantee the receipt of any mailings within the described timeframe
for eligibility for play unless sent via Federal Express, UPS or
similar provider with same day delivery, which can become quite
costly. This game is designed for simplified play via the Internet.
At no time will team roster formation via matchup selections be
accepted if emailed to the Game Commissioner via the “Commissioner
Contact” tab located on the top of the homepage.
- Free team play is allowed. In order to qualify for free
play, instead of pay to play, all team rosters must be received by
FantasyDriverMatchup.com no later than 24 hours prior to the
scheduled start of the upcoming shootout that the player wishes to
compete in. Free team requests and team roster formation via matchup
selections MUST be mailed to PO Box 841092, Houston, TX 77284. At no
time will free team managers be awarded a prize, even if the team
scores within a prize earning position of the division the free team
manager is competing in. If a free team manager does finish in a
prize earning position, the free team will be skipped during prize awarding. Matchup
selection must be included with your request as they will be
processed at the same time. If you do not include the matchup
selections with your request, the request for a free team will not
be fulfilled.
- Directors, officers and employees of
FantasyDriverMatchup.com, it’s affiliates and subsidiaries, the
promotional partners and suppliers, their immediate families, other
directors, officers and employees are not eligible to win any
prizes. However, please understand that the creator of this game
will play the game, but only for the competition. The creator if
scored in a prize winning position, will forfeit the prize won and
for prize purposes only will be skipped during ranking calculations.
The creator designed this game as a fantasy racing competitor, based
upon what the creator would have liked to have seen in a fantasy
racing game. To the creator’s knowledge there is not another matchup
based fantasy racing game similar to FantasyDriverMatchup.com on the
Internet. Otherwise, this site would have never been created. The
creator of the game is a fantasy racing gamer and wanted an outlet
for competition within the matchup style format.
- This game may not be used in any connection with any form of
gambling. If you have a gambling addiction please utilize your
access to the Internet to obtain information about what you can do
to help control your addiction. FantasyDriverMatchup.com does not
condone, in any way, gambling of any sort.
- FantasyDriverMatchup.com and any of its affiliates and/or
subsidiaries will not be responsible for any game disruptions,
injuries, losses or damages caused by events beyond the control of
FantasyDriverMatchup.com. Should an act occur that disrupts the
play within FantasyDriverMatchup.com for a specific shootout, all
entries will be credited for play in the next available shootout.
- Participants must purchase a team and select matchup choices to
create a team roster. These selections must be made before the
clock found on the homepage has counted to zero. At no time will
exceptions be made for this time consideration. ALL matchup choices
must be entered and saved prior to the “Countdown” clock reaching
zero.
- The game will be open for matchup selections late Wednesday night.
- Results will be available no later than 7pm CST on the
Tuesday following a race.
However, in most instances results will be posted Monday morning or right after completion of the race.
- Matchup design is at the sole discretion of
FantasyDriverMatchup.com and any matchups posted on the matchup menu
page will be available for gameplay within the format of play set
forth in the rules page.
- All prizes are paid in the form of a check mailed to the
winning contestant and all prizes are paid in the form of US
Dollars, drawn upon a bank in the US. All cash prizes are
awarded without warranty of any kind, express or implied.
FantasyDriverMatchup.com is not responsible for any issues or
problems regarding the actions required to cash the prize checks.
However, if there is a problem in presenting the check to a US bank,
please contact FantasyDriverMatchup.com at the commissioner contact
tab found on the homepage. We will attempt to assist you in any way
that we possibly can. We will not mail cash under any circumstances.
- Any printing or typographical errors in any materials
associated with the game will not void or change in any way the
matchup choices made by team owners. Team owners are responsible
for ensuring that they understand which drivers/car numbers are
competing within each matchup and the choices made within each selection.
- Prizes are to be awarded and processed no later than 10-14
business days from the completion of the shootout. Prize winners
will be notified via US mail in the form of a receipt of a check
from fantasydrivermatchup.com or each team player can review the
posted results that are available no later than 7pm CST on the
Tuesday following the race. The prize is nonassignable and
nontransferable. In the event a winner can not be contacted via US
mail or by using the information provided in the player
information screen, the prize will be held for 60 days. If
FantasyDriverMatchup.com is not notified of a lack of receipt of the
prize by a player within 60 days of the scoring of the event, that
prize will be voided and returned to the control of
FantasyDriverMatchup.com. Please note that we will make every
attempt possible to provide the winner with his or her prize.
- Winners are solely responsible for the reporting and payment
of any taxes of any kind generated by winning any prize from
FantasyDriverMatchup.com to any authority effected by the winning of
a prize by a prizewinner within the jurisdiction of that authority.
FantasyDriverMatchup.com will in no way be responsible to any person
or entity for a player’s lack of action regarding the responsibility
to report the winning of a prize to any authority. A prize winner
will be required to sign and return an Affidavit of Eligibility and
Liability Release along with a W-9 form for any prize over $600.00.
Once the documents are returned, we will mail the issued prize check
to you.
- The endorsement and presentation of a check from
FantasyDriverMatchup.com to any bank for the purpose of “cashing of
a prize check” will result in an agreement between the listed person
on the prize check and FantasyDriverMatchup.com to indemnify,
protect and hold harmless FantasyDriverMatchup.com from any and all
legal or other actions that may occur by virtue of playing the game
and winning a prize.
- This game is subject to the Terms and Conditions of use
throughout this website and any other form of information generated
by FantasyDriverMatchup.com and other rules expressed herein.
Game participants agree to abide by the Terms and Conditions of Use,
the game rules and by the decisions of FantasyDriverMatchup.com
which are final on all matters pertaining to the game.
- Should a change to the rules, content, terms or conditions of
this game be needed a notification will be posted within the website
for all to view. The purchase of a team and the playing of the
game will constitute agreement with all Terms, Conditions and Rules
expressed herein by the player with the language set forth herein.
- The information contained within FantasyDriverMatchup.com may
not be duplicated without consent of FantasyDriverMatchup.com for
any purpose, except to play FantasyDriverMatchup.com.
- Users are solely responsible for any charges or obligations
that may be incurred as a result of any dealings with website
operators or advertisers. Other websites may have links to this
website. As a user of FantasyDriverMatchup.com you acknowledge and
agree that FantasyDriverMatchup.com is not responsible for the
content of any such website or the actions of any operator of any
such website.
- This website and all materials associated with it including
but not limited to software, text, images, graphics, illustrations,
logos, patents, trademarks, service marks, copyrights, photographs,
audio, video etc are or may be protected by the US and worldwide
copyrights which are owned or licensed, in whole or in part by
FantasyDriverMatchup.com. Intellectual property or content
within this site may not be reproduced, edited, manipulated,
performed, republished, uploaded to or downloaded from, transferred
or posted to or otherwise distributed or exploited in any manner
whatsoever. All content within this website and any advertisement
etc of it is the property of FantasyDriverMatchup.com. Any
ill-intended use of this website, to include theft of intellectual
property will be prosecuted under the fullest extent of the law. As
a user of this website or a player within it, you agree to notify
FantasyDriverMatchup.com of any infringement or ill-intended use of
this website by an unauthorized person, company, entity or
individual immediately.
- By virtue of playing the game you agree to release and hold
harmless FantasyDriverMatchup.com or any of it’s employees,
creators, directors, advertisers, or any other person or business
that has a relationship with FantasyDriverMatchup.com from any and
all liability asserted or otherwise that is argued to arise from
this game and website in any form. You agree to release and
holdharmless FantasyDriverMatchup.com and any stated party
affiliated or associated in any way with FantasyDriverMatchup.com
from any liability whatsoever for any claims, costs, injuries,
losses, or damages of any kind arising out of or in connection with
FantasyDriverMatchup.com for any reason.
- If FantasyDriverMatchup.com is required to make changes to
the content, set up, or rules of the game by any legal or regulatory
authority, FantasyDriverMatchup.com reserves the right to
discontinue or modify the game or to disqualify certain participants
for any reason due to such actions.
- FantasyDriverMatchup.com is not an “official” site of NASCAR,
nor is it affiliated with NASCAR in any way. This game is not
intended to be an association with NASCAR. The game is simply based
on the NASCAR points system and the drivers and teams that compete
within NASCAR’s sanctioned events. We are fans of the sport, not a
part of it.
- If any error has occurred with your scoring of matchups
please notify us as soon as possible, via the commissioner contact
tab found on the homepage. See the rules tab for the
instructions in reference to notifying FantasyDriverMatchup.com
about any error calculations that may have arisen. We will attempt
to correct the scoring problem as soon as possible.
- FantasyDriverMatchup.com strongly believes in the privacy of
our players and we will protect your information to the best of our
ability. Should security be compromised we will notify you as
soon as possible. We will use your information for internal game
purposes only, to include advertising to you. We will not sell your
information, in the form of names lists or any other form for any
reason. However, FantasyDriverMatchup.com reserves the right to send
printed information or emails to you for the purpose of advertising
the game directly to you.
- Void where prohibited by law.
- In the event that the awarding of any prize to winners of the
game is challenged by any legal, governmental or taxation authority,
FantasyDriverMatchup.com will reserve the right to, at our
discretion, determine whether or not to award such prizes.
Should a prize award be placed into review, the prize will be held
in the prize winner's name until the issue can be resolved. Once the
winner provides documentation to relieve FantasyDriverMatchup.com of
any liability, real or perceived, from any legal, governmental or
taxation authority, the prize check will be released to the winner.
- Any prize winner, by the acceptance of any prize, grants
permission to FantasyDriverMatchup.com to use their name and/or
likeness for publicity or promotional purposes without further
compensation, unless prohibited by law and agrees to execute a
written consent.
- In the event the identity of a player is disputed for any
reason that person will be required to show evidence to support
their identity via governmental documentation. On-line identity
will be deemed to be the authorized account holder of the email or
ISP contract used to obtain access to the team manager's teams in
addition to governmental documentation.
